The Department of Homeland Security is
Attempting to Force America into an Illegal Contract that will Erase your Bill
of Rights and Place Your Livelihood in Jeopardy.
On December 31, 2009 H.R. 418 or The Real ID Act of 2005 will be enforced nationwide. Real ID was initially rejected by congress and then in May of 2005, James F. Sensenbrenner slipped Real ID onto H. R. 1268 as a rider. H. R. 1268 was a bill designed to aid the soldiers in the war and Mr. Sensenbrenner knew it would not fail to pass.
Although Real ID is called a voluntary program, anyone who refuses to volunteer will not be able to renew their driver’s license. Without your driver’s license you will not be able to:
1) Open or maintain a bank account.
2) Engage in commercial travel and commercial activity.
3) Vote.
4) Apply for a job.
5) Enter a federal building.
The list is much longer than that, however for brevity I will stop there. The Department of Homeland Security (DHS) does not actually have the authority to enforce this program. The DHS is a contract agent of the federal government and is subject to constitutional law just as you and I are.
Legislators should be reminded that the federal government is an agent of the states and must obtain state to state approval before instituting programs. In addition, if any program violates the bill of rights, each state has the authority to opt out of the program without penalty. In this way each individual state can be held accountable for violations independent of where the program originated.
WHAT IS REAL ID AND HOW WILL IT AFFECT YOU?
The Real ID Act started off as H.R. 418 in 2005. Unfortunately many bills do not get read or reviewed by those who vote on them and many bills are slipped through on the backs of other bills. This results in much legislation which does not truly represent the will of the people.
The Real ID Act is the legislation needed to impose a National ID. Under the Real ID program the American citizen will be required to accept an (RFID) or Radio Frequency Identification Device embedded in the driver’s license and state ID’s. These are called “enhanced driver’s licenses”. Several states are already issuing the “enhanced driver’s license” and the DHS has already stated that this will become a standard.
Since even the federal government does not have the authority to force the issuance of an RFID without the written consent of the recipient, the DHS is calling this a voluntary program. As you can see the issuance will be enforced simply by making it impossible to function without it.
But what if you do “volunteer” by signing forms which contract you into the DHS Real ID system? All your personal information will be concentrated onto this ultra-miniature chip which will include all of your financial data, medical and health history, education and employment information, every thing you own, and anything you buy or sell, all of your travel itineraries and anything else someone may want to include. Your personal privacy will be completely gone and your personal information will be subject to exploitation by those who do not have your best interests in mind. Your financial accounts could be wiped out without your knowledge or consent.
At this time there are no plans in place to control access to this information, but an RFID chip can be turned on and off. You would not be certain that your ID chip would not be turned off if you became an antiwar protestor, or if you were persistent about expressing or publishing “politically incorrect” viewpoints. One wrong step and you would be in the same position as those who refuse the chip in the first place. Such is the serious nature of the Real ID legislation. All fifty states have the ability to opt out of the Real ID program if they feel it is contrary to the constitution.
WHAT IS AN RFID?
An RFID is a Radio Frequency Identification Device (a microchip). It will store your personal data so it can be read by a special reader. If Real ID is not blocked, it will be easy for the DHS to phase in a sub dermal representation of this program. The DHS has gone to great effort to keep you from knowing anything about that yet.
The Real ID Act is the railroad tracks for the sub dermal ID’s. A sub dermal ID is an RFID in the form of a biochip. A biochip is a microchip enclosed inside a glass tube to prevent corruption of the circuit. Most are about the size of a grain of rice. The (IMI) or Intelligent Manned Interface is just one of several biochips that could be used for this purpose. It will house information that in many cases would be regarded as private and can be inserted into the body with a special syringe. There are also machine readable tattoos being developed which could serve this purpose.
Applied Digital, Data Angel and The Verichip Human Implant Co. are just a few of the companies currently competing for the contracts to mass produce these biochips for implanting in the human host.
INTERNATIONAL ID
Almost all states belong to what is known as the DLC or Driver’s License Compact. AAMVA or American Association of Motor Vehicle Administrators is asking states to join the DLA or Driver’s License Agreement. One of the main differences in the DLC and the DLA is that the DLA has provisions in it that allow Mexico and Canada to participate in the sharing of information. AAMVA is an international organization and under this new deal Americans would be forced to accept an international driver’s license or state ID.
The Privacy Act of 1974 specifically prohibits any creation of a national ID. The Real ID Act will create a de facto international ID. (EPIC) Electronic Privacy Information Center has warned that Real ID will severely decrease our security level.
THE USA PATRIOT ACT VERIFICATION FORM
Currently, Real ID is being subtly enforced through a document called a Patriot Act Verification Form. I will include one of these at the end of this letter. You will be asked to fill out this document when opening a bank account, applying for a job, doing your taxes, and just about everything that requires a transfer of data. The object of this form is to verify that you have a valid, unexpired driver’s license.
If the Real ID Act did not exist, The Patriot Act Verification From would be harmless. However, as long as Real ID remains on the books, this form forces your compliance. It is also interesting to note that one of the chief authors of the Patriot Act is Michael Chertoff who is also the head of the DHS who is enforcing Real ID. So you can see that these two pieces of legislation a re inter-related.

Any legislation which does not work in concert with your constitutional rights is an attack on your constitutional rights. [Elden says Supreme Court ruled anything conflicting with Constitution is void - but we have to see it, and fight it in court to win back our rights. WHAT CAN YOU DO ABOUT REAL ID?
You can help get Real ID off the federal books by urging your representatives to support the Baucus-Tester and Grassley-Baucus amendments to the current immigration bill making its way through the Senate. This will strip Real ID provisions from the bill.

Jonathan Miller and several other legislators have co-authored a bill, H.B. 3219, which will block the Real ID program in West Virginia. Unfortunately this bill did not garner enough attention from the public to get introduced. However, if you take into account that the media has failed to cover this issue in proper detail, it is easy to understand why no one has heard of Real ID. The legislature is taking an extension, but this bill is still not on the roster for consideration. If you wish to light a fire under the legislature to get this bill passed…..you may want to act fast.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new article, designated §17B-7-1, to read as follows:
ARTICLE 7. DIVISION NOT TO PERFORM CERTAIN ACTS.
§17B-7-1. Legislative finding; prohibiting implementation of "REAL ID Act."
(1) The Legislature finds that the enactment into law by the United States
Congress of the "REAL ID Act of 2005", as part of Public Law 109-13, is inimical
to security and well-being of the people of West Virginia, will cause unneeded
expense and inconvenience to the people of this state, and was adopted by the
United States Congress in violation of the principles of federalism contained in
the tenth amendment to the United States Constitution.
(2) The State of West Virginia will not participate in the implementation of the
"REAL ID Act of 2005." The Department of Transportation, including the Division
of Motor Vehicles, is directed not to implement the provisions of the "REAL ID
Act of 2005" and to report to the Governor any attempt by agencies or agents of
the United States Department of Homeland Security to secure the implementation
of the "REAL ID Act of 2005" through the operations of that division.
